1. Seller

The website obiprimeproducts.com is operated by Netmart LLC, County of Sussex, 16192 Coastal Hwy, Lewes, DE 19958-3608, United States (“Netmart”, “we”). Netmart LLC is the seller of the products offered on this website and is the party with whom the purchase contract is concluded. You can contact us through the contact form on our homepage.

2. Scope

These Terms and Conditions apply to every purchase of products made on obiprimeproducts.com by a consumer, i.e. a natural person acting for purposes outside their trade, business, craft or profession. They do not limit any right that the consumer has under the mandatory consumer protection rules of the country in which the consumer habitually resides, including Directive 2011/83/EU and, for consumers resident in Italy, Legislative Decree no. 206 of 6 September 2005 (Consumer Code).

3. Products and prices

The main characteristics of each product are described on its product page. The price shown on the product page and in the order form is the total price payable by the consumer. Any additional cost, if applicable, is indicated before the order is sent. Images are for illustration; in case of doubt, the written product description prevails.

4. How the contract is concluded

To place an order, the consumer fills in the order form on the product page with the data requested (name, telephone number and delivery address) and sends it. Sending the form constitutes an order with an obligation to pay. We may contact the consumer by telephone or e-mail to confirm the order and the delivery details. The contract is concluded when we confirm the order. We may refuse an order, for example if the product is not available or the delivery data are incomplete; in that case no payment is due.

5. Payment

The only payment method accepted on this website is cash on delivery: the consumer pays the total price to the courier when the goods are delivered. No payment is requested before delivery.

6. Delivery

Products are delivered to the address indicated in the order form. Unless a different term is indicated on the product page or agreed with the consumer, we deliver without undue delay and in any case no later than 30 days from the conclusion of the contract. If we fail to deliver within the agreed term, the consumer may set an additional appropriate period and, if delivery does not take place within it, terminate the contract; any amount paid is then refunded without undue delay. When receiving the goods, the consumer is invited to check that the package is intact and to note any visible damage on the courier’s delivery note; this does not affect the consumer’s rights under the legal guarantee of conformity. 7. Right of withdrawal

The consumer has the right to withdraw from the contract within 14 days without giving any reason and without any penalty (Articles 52–59 of the Italian Consumer Code; Articles 9–16 of Directive 2011/83/EU). The withdrawal period expires 14 days after the day on which the consumer, or a third party indicated by the consumer other than the carrier, acquires physical possession of the goods (for an order of several goods delivered separately, of the last good).

To exercise the right of withdrawal, the consumer must inform us of the decision to withdraw by an unequivocal statement, for example through the contact form on our homepage. The consumer may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient to send the communication before the withdrawal period has expired.

Effects of withdrawal. If the consumer withdraws, we will reimburse all payments received from the consumer, including the costs of delivery (with the exception of the supplementary costs resulting from the choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed of the decision to withdraw. Because payment is made in cash on delivery, the reimbursement is made by bank transfer to the account indicated by the consumer, free of charge. We may withhold reimbursement until we have received the goods back or until the consumer has supplied evidence of having sent back the goods, whichever is the earliest.

The consumer must send back the goods without undue delay and in any event not later than 14 days from the day on which the withdrawal was communicated to us. We will provide the return address together with the acknowledgement of the withdrawal. The consumer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods. The right of withdrawal is not subject to the goods being unused or in their original packaging.

The right of withdrawal does not apply in the cases listed in Article 59 of the Italian Consumer Code and Article 16 of Directive 2011/83/EU, for example sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery. Where such an exception applies to a product, it is indicated on the product page.

8. Legal guarantee of conformity

All products are covered by the legal guarantee of conformity provided by Articles 128 and following of the Italian Consumer Code and by Directive (EU) 2019/771. Netmart LLC is liable to the consumer for any lack of conformity which exists at the time of delivery and becomes apparent within two years of delivery. In case of lack of conformity, the consumer is entitled to have the goods brought into conformity by repair or replacement free of charge or, where the conditions provided by law are met, to a proportionate price reduction or to the termination of the contract. The legal guarantee is a right granted by law; it is separate from, and not to be confused with, the right of withdrawal.

9. Personal data

Personal data provided with the order are processed by Netmart LLC to manage the order and the delivery, as described in our Privacy Policy and Cookie Policy.

10. Complaints

Complaints can be sent through the contact form on our homepage. We will reply without undue delay.

11. Applicable law and jurisdiction

Nothing in these Terms and Conditions deprives the consumer of the protection afforded by the mandatory provisions of the law of the country in which the consumer has their habitual residence. For any dispute with a consumer, the courts of the place where the consumer resides or is domiciled have jurisdiction where this is required by mandatory law.

We may update these Terms and Conditions. The version published on this page at the time the order is sent applies to that order.
